MESKWAKI YOUTH SPORTS WAIVER AND RELEASE
My child has been offered the opportunity to participate in the
Meskwaki Youth Program ("MYP") which runs ( ) through ( ).
Participantovernight trips and transportation by MYP staff. As a condition of my child participating I hereby agree to the following: 1) Participation is a privilege given to my child, which can be revoked at any time, participation is completely voluntary and I have elected to take advantage of this offer. If I or my child do not follow all written or verbal commands issued by MYP permission for my child to participate shall be immediately revoked and permission to participate in future events may be denied. 2) MYP, its employees, or agents have the right to take photographs of my child to use in any and all media now or hereafter. I release all rights to exhibit this work in print and electronic form publicly or privately and to market and sell copies. I waive any rights, claims, or interest to financial reimbursement for photographing my child. 3) I acknowledge and fully understand that by participating my child will be engaging in activities that can involve risk of serious injury, which may include permanent disability and even death, and severe social and economic losses which might result not only from their action, inaction, or negligence, but also from the action, inaction, or negligence of others. I expressly assume all risks of injury, including death, which may occur in connection with participation and accept full responsibility for my own and my child's damages following such injury, disability, or death. 4) I and my child agree not to sue the Tribe and any of its agents, affiliates, associates, officers, directors, employees, enterprises, and departments, including the MYP ("Related Parties" 5) I agree to release, waive, discharge, and hold harmless the Tribe and Related Parties from demands, losses, or damages on account of any bodily injury, death or property damage resulting from my child's participation. 6) I also agree to indemnify and defend the Tribe and Related Parties from any and all third party claims caused in whole or in part by my actions or my child's actions. 7) Neither I nor my child are an employee of the Tribe or Related Parties, the Tribe's Employee Handbook does not apply to us, and we are not entitled to any rights or benefits of an employee of the Tribe or Related Parties. 8) I expressly agree that the terms of release and indemnity contained herein are intended to be read as broad and inclusive. This Agreement is governed by the laws of the Sac & Fox Tribe of the Mississippi in Iowa, and I hereby expressly agree to the sole jurisdiction of the Courts of the Sac & Fox Tribe of the Mississippi in Iowa as the sole venue for any action arising hereunder. This Agreement is binding on my personal representatives, estate, administrators, and assigns.
